In consideration of granting me the opportunity to test ride the electric bicycle within a reasonable distance from the "Ristretto Electric" and "Ristretto Squadra" retail location, in accordance with the laws of the United States, I hereby acknowledge that I comprehend and explicitly consent to the subsequent stipulations and provisions: I hereby affirm and attest to "Ristretto Electric" and "Ristretto Squadra" that: (a) I am at least 18 years old; (b) The information I have supplied to "Ristretto Electric" and "Ristretto Squadra" in connection with this Agreement is accurate and complete to the best of my knowledge; and (c) I am not afflicted by any medical condition that would reasonably be expected to impede my ability to safely operate the electric bicycle. Additionally, I affirm and confirm that I have neither consumed nor will I be under the influence of any alcoholic beverage, controlled substance, or other substance that possesses or could potentially induce a sedative or intoxicating effect, both now and during the electric bicycle ride. I recognize that a representative from "Ristretto Electric" and "Ristretto Squadra" has provided me with ample information about the key attributes of the electric bicycle that I intend to test ride, along with instructions for its secure operation. I further acknowledge that I have been afforded sufficient opportunity to seek clarifications from a "Ristretto Electric" and "Ristretto Squadra" representative regarding any additional inquiries I deem necessary to responsibly operate the electric bicycle, adhering to the terms outlined in this Agreement. If I discern any malfunction with the electric bicycle, I commit to discontinuing its use and promptly returning it to "Ristretto Electric" and "Ristretto Squadra". I pledge to adhere to all policies, regulations, and rules established by "Ristretto Electric" and "Ristretto Squadra" concerning the test ride, in addition to all pertinent traffic laws, encompassing those related to vehicle safety, operation, insurance, as well as the consumption of alcoholic beverages or other substances that may elicit a sedative or intoxicating effect. I accept full responsibility for any non-compliance with the aforementioned policies, regulations, and/or laws. In the event of an injury or emergency during the test ride, I will dial 911. Furthermore, I undertake to promptly notify "Ristretto Electric" and "Ristretto Squadra", my insurance provider, and the local law enforcement agency regarding any accidents, injuries, or damages arising from my operation of the electric bicycle. Upon reasonable request by "Ristretto Electric" and "Ristretto Squadra", I will promptly furnish all documents, notifications, and pleadings received by me or on my behalf pertaining to any claims, lawsuits, or legal actions related to my use of the electric bicycle. I acknowledge that my voluntary participation in the electric bicycle test ride entails: (a) inherent hazards and risks to both myself and others, including but not limited to collisions, overturning, slipping, falling, and equipment malfunction, which could result in temporary or permanent injury, or even fatality, (b) the potential for damage to, or total loss of, the electric bicycle, and (c) the possibility of harm to personal belongings in my possession during the test ride. "Ristretto Electric" and "Ristretto Squadra"' (limited) liability as stipulated in this Agreement, I hereby indemnify and absolve "Ristretto Electric" and "Ristretto Squadra", its affiliated entities, its and their directors and staff, dealers, and other associates (collectively referred to as the "Indemnified Parties") from any and all other claims, requests, legal actions, causes of action, suits, expenses, costs, obligations, judgments, losses, or liabilities, including reasonable legal fees, which may arise directly or indirectly, whether due to my negligence or otherwise, from my utilization or operation of the electric bicycle. This encompasses, but is not limited to, claims arising from personal injury, death, or property damage. Despite "Ristretto Electric" and "Ristretto Squadra"’ (limited) liability as stipulated in this Agreement, I hereby release, renounce, and discharge each of the Indemnified Parties from any and all additional liability to me and my insurers for any and all loss or damage, along with any claims or demands relating thereto, on the grounds of injury to, or death of, any individual or damage to any property. This release pertains directly or indirectly to my operation or use of the electric bicycle, regardless of whether such issues stem from my negligence or otherwise. I further pledge not to bring legal action against any of the Indemnified Parties in connection with such loss, damage, claim, or demand. Should I decide to file a lawsuit, I consent to bearing any reasonable attorney fees, costs, or judgments incurred by the Indemnified Party, except if the Indemnified Party is held liable. This agreement extends to third parties and holds legally binding force. I concur that the provisions of this Agreement are meant to be as expansive and comprehensive as permitted by law. In the event that a portion of this Agreement is deemed invalid, the remainder shall remain in full legal effect. I provide these covenants and affirmations with a full understanding that "Ristretto Electric" and "Ristretto Squadra" relies upon each of them. This document applies to my use or operation of any and all electric bicycles during my visit to the "Ristretto Electric" and "Ristretto Squadra" retail location and will remain in effect indefinitely following each test ride.
